Welcome to Costimator. These Terms of Service (“Terms”) govern your access to and use of the Costimator application and the costimator.in website (collectively, the “Service”). The Service is provided by Create2Inspire Pvt. Ltd. (“Costimator”, “we”, or “us”).
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract under Indian law
- Not be barred from using the Service under any applicable law
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
The Service is not intended for use by minors. If we discover an account has been created by someone under 18, we will close the account and delete associated data.
2. Your Account
2.1 Account Creation
To use the Service, you create an account by providing your name, email address, phone number, organization name, and job title. You are responsible for maintaining the accuracy of this information and updating it as needed.
2.2 Account Security
You are responsible for safeguarding your account credentials. You agree not to share your credentials with any third party. You will notify us immediately at support@costimator.in if you suspect unauthorized access to your account.
You are responsible for all activity that occurs under your account, whether or not authorized by you.
2.3 One Account Per User
Each Costimator account is for use by a single individual. You may not share your account with others, and you may not create multiple accounts to circumvent subscription limits or pricing.
3. Subscription Plans and Pricing
3.1 Free Trial
New users receive a 14-day free trial with full feature access. No credit card or payment information is required to start the trial.
After the trial expires, your account is locked and the Service becomes inaccessible until you subscribe to a paid plan. Project data created during the trial (estimates, NS items, justifications) is preserved for 14 days after trial expiry, after which it is permanently deleted.
3.2 Paid Plans
We offer the following paid subscription plans:

All prices are exclusive of applicable Goods and Services Tax (GST), which will be added at the prevailing rate at the time of payment.
Pricing on this page is indicative; the prices in effect at the time of subscription are those displayed on the costimator.in pricing page at that time.
3.3 Student Discount
Verified students receive a 50% discount on subscription pricing. To claim the discount, email proof of student status to support@costimator.in. We verify student status and apply the discount manually. We retain a record of verification but delete submitted ID images within 30 days of verification.
3.4 Plan Upgrades
If you are on the Pro plan, you may upgrade to the Diamond plan within 14 days of starting your subscription, with the new pricing prorated against the remaining subscription period. After the 14-day window, plan upgrades take effect at the next renewal.
Plan downgrades are not permitted mid-cycle. You may downgrade at the time of renewal.
3.5 Auto-Renewal
Paid subscriptions automatically renew at the end of each billing period (annual or monthly) unless you cancel. We will send you an email reminder before the renewal charge.
By subscribing, you authorize us (through Stripe) to charge your saved payment method for renewals at the then-current price. The renewal price may differ from your initial subscription price; we will notify you of any price changes at least 30 days before they take effect.
3.6 Cancellation
You may cancel your subscription at any time through your account settings within the application, or by emailing support@costimator.in. Cancellation prevents future automatic renewals; it does not produce a refund for the current billing period.
After cancellation, you retain access to the Service until the end of your current paid period. After that period ends, your account follows the post-trial behavior described in Section 3.1.
4. Refunds
Subscription fees are generally non-refundable. We do not offer refunds for change of mind, lack of use, accidental purchase, or general dissatisfaction.
However, refunds may be considered, at our sole discretion, for documented service failures such as:
- Prolonged service unavailability that materially prevents you from using the Service
- Substantial failure of the Service to deliver functionality as described
- Duplicate billing or billing errors
Refund requests must be submitted in writing to support@costimator.in within 14 days of the issue arising. Each request is evaluated on its individual merits, and our decision is final.

5. Payment Terms
All payments are processed by Stripe, Inc. By providing payment information, you authorize Stripe to charge the specified amount.
If a payment fails or is reversed (including chargebacks), we reserve the right to suspend or terminate your account until payment is resolved. You are responsible for any costs associated with payment reversal disputes.
We accept payment by Credit/Debit Card (via Stripe), direct bank transfer, and government Purchase Order. Detailed payment instructions for bank transfer and PO are available on request.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Service to violate any applicable law, regulation, or third-party right
- Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service
- Use any automated system (bot, scraper, crawler) to access or extract data from the Service, except as expressly permitted
- Attempt to gain unauthorized access to any portion of the Service, other accounts, or our infrastructure
- Interfere with or disrupt the Service or servers/networks connected to the Service
- Use the Service to transmit malicious code, viruses, or harmful content
- Resell, sublicense, or redistribute the Service without our express written authorization
- Misrepresent your identity or impersonate any person or entity
Violation of this Section may result in immediate suspension or termination of your account.
7. Your Content and Data
7.1 Ownership
You retain ownership of all content you create through the Service, including estimates, projects, non-scheduled items, justifications, and reports (“Your Content”).
7.2 License to Costimator
You grant Costimator a limited license to host, store, transmit, and display Your Content solely as needed to provide the Service. This license terminates when Your Content is deleted from our systems.
7.3 Data Backup
Although we maintain backups of our database for operational continuity, we recommend that you periodically export your project data using the in-app Excel export feature. We are not liable for loss of data resulting from your inability or failure to back up Your Content.
8. Our Intellectual Property
The Costimator name, logo, software, design, content, and all related intellectual property are owned by Create2Inspire Pvt. Ltd. or its licensors. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. No other rights are granted.
Schedule of Rates (SoR), Daily Schedule of Rates (DSR), Analysis of Rates (AoR), Daily Analysis of Rates (DAR), and similar materials produced by government departments (CPWD, Indian Railways, MoRTH, etc.) are the property of those respective departments. Costimator displays this content under the assumption that the materials are publicly available reference data.
9. Service Availability and Modifications
9.1 Best-Effort Service
We strive to provide reliable Service availability but do not guarantee uninterrupted, error-free, or secure access. The Service may experience downtime for maintenance, upgrades, or unexpected issues.
We do not currently offer a Service Level Agreement (SLA) for the standard subscription plans. Enterprise customers may negotiate SLA terms separately in writing.
9.2 No Refunds for Downtime
Downtime, performance issues, or technical problems that occur in the ordinary course of operating the Service do not entitle you to refunds, credits, or service extensions, unless we expressly agree otherwise.
9.3 Service Modifications
We may modify, update, or discontinue features of the Service at any time. We will provide reasonable advance notice for material changes that significantly reduce functionality of paid plans.
10. Termination
10.1 Termination by You
You may terminate your account at any time by canceling your subscription as described in Section 3.6 and submitting a deletion request as described in our Privacy Policy.
10.2 Termination by Us
We may suspend or terminate your account immediately if:
- You materially breach these Terms
- You fail to pay subscription fees when due
- Your use of the Service poses a security or legal risk to Costimator or other users
- Required by law or court order
We will attempt to notify you before termination where reasonably possible. We are not liable for any loss resulting from termination for cause.
10.3 Effect of Termination
Upon termination, your right to use the Service ends immediately. Project data is handled per the retention schedule in our Privacy Policy. Sections that by their nature should survive termination (intellectual property, limitation of liability, governing law, etc.) will continue to apply.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
Specifically, we make no warranties that:
- The Service will be uninterrupted, secure, or error-free
- The estimates, calculations, or reports produced will be free from errors or suitable for any particular purpose
- The Service will meet your specific requirements
Estimates and rate analyses produced through the Service are computational outputs based on the data and parameters you input. While we endeavor to maintain accurate Schedule of Rates data and methodology, the responsibility for verifying outputs against project requirements, applicable regulations, and engineering judgment rests entirely with you. Costimator does not provide professional engineering, legal, or financial advice.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Our total cumulative liability to you for any and all claims arising from or relating to the Service is limited to the amount you have paid Costimator in the 12 months preceding the event giving rise to the claim.
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, business interruption, or cost of substitute services.
- We are not liable for damages arising from your use of estimates, calculations, or reports produced through the Service for any purpose, including bidding, project costing, or contractual decisions.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify and hold harmless Create2Inspire Pvt. Ltd., its officers, directors, employees, and contractors, from any claim, loss, damage, liability, or expense (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your violation of any law or third-party right
- Your misuse of the Service
- Your reliance on outputs produced by the Service for any purpose
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of competent jurisdiction in India.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to active users by email at least 14 days before they take effect. Non-material changes (corrections, clarifications, formatting) may be made without notice; the “Last updated” date at the top reflects when changes were made.
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, and Cookie Policy, constitute the entire agreement between you and Costimator regarding the Service.
16.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
16.3 No Waiver
Our failure to enforce any provision is not a waiver of our right to do so subsequently.
16.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms (e.g., in connection with a corporate restructuring or sale of business) without your consent.
16.5 Force Majeure
Neither party is liable for delays or failures in performance caused by circumstances beyond reasonable control (natural disasters, government actions, infrastructure outages of third-party providers, etc.).
16.6 Notices
Notices to you may be sent to the email address on file for your account. Notices to us must be sent to support@costimator.in.
16.7 Language
These Terms are in English. In the event of any inconsistency between the English version and any translation, the English version prevails.
